Terms of Service
Effective [confirm launch date]
These Terms of Service ("Terms") are an agreement between AkerHub ("we", "us")[confirm legal entity name and registered address] and the company that signs up to use SiteHub ("Customer", "you"). By completing setup, or by using SiteHub, Customer's administrator agrees to these Terms on behalf of the company.
1. The service
SiteHub is job, crew, payroll, inventory and invoicing management software for construction companies. Each Customer receives their own dedicated deployment and database, set up once through the one-time company setup process. Pricing is agreed separately, by custom quote, and billed outside this platform unless we tell you otherwise in writing.
2. Accounts & responsibilities
- Customer's admin is responsible for creating and managing employee accounts, assigning roles, and deciding who can see what within their own deployment.
- Customer is responsible for the accuracy of the data they enter - job details, pay rates, client information and anything else - and for keeping login credentials secure.
- Customer is responsible for their own employees' compliance with these Terms while using SiteHub on the Customer's behalf.
3. Acceptable use
You agree not to:
- Use SiteHub for anything unlawful, or to store or transmit content you don't have the right to;
- Attempt to access another customer's deployment or data, or to bypass access controls;
- Reverse-engineer, decompile, or attempt to extract the underlying source code of SiteHub, except where the law gives you that right despite this restriction;
- Interfere with or disrupt the integrity or performance of the service.
4. Your data
Customer owns all data they put into SiteHub - job records, client information, employee records, photos, financial data, all of it. We process it only to provide the service to you, as described in our Privacy Policy. You can export your data at any time in standard formats (CSV/PDF) from within the product.
5. Fees & payment
Fees are whatever amount is agreed with you separately (by quote or invoice), billed on the schedule we agree to. If an invoice goes unpaid past its due date, we may suspend access after giving reasonable written notice, until the account is brought current.
6. Service availability
We aim to keep SiteHub available and reliable, and we host it on established infrastructure providers (Supabase and Vercel). That said, we don't guarantee uninterrupted or error-free operation, and we aren't liable for outages caused by those providers or by factors outside our reasonable control. We'll give notice of planned maintenance where practical.
7. Intellectual property
We own SiteHub - the software, its design, and underlying technology. These Terms give you the right to use it; they don't transfer any ownership of it to you. Your data stays yours, as described in Section 4.
8. Confidentiality
Each party will protect the other's confidential information with reasonable care, and use it only to perform under these Terms - this includes your business and employee data on our side, and anything about our product or business you learn that isn't publicly known.
9. Limitation of liability
To the extent allowed by law, neither party is liable to the other for indirect, incidental, or consequential damages. Our total liability to you under these Terms is capped at the fees you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability where the law doesn't allow it to be limited.
10. Termination
Either party may terminate with written notice [confirm notice period - e.g. 30 days], or immediately if the other materially breaches these Terms and doesn't fix it within a reasonable period after being told. On termination, we'll make your data available for export, and will delete it from our systems within a reasonable period afterward [confirm exact number of days - should match the Privacy Policy] unless the law requires us to keep it longer.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
12. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we'll let Customer's admin know and update the date at the top of this page.
